This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA). It explains what records Atlantic Forest (Pty) Ltd t/a Atlantic Palms holds and how to request access to them.

2. The Regulator’s guide on how to use PAIA

The Information Regulator has compiled a guide, as contemplated in section 10 of PAIA, containing information to assist a person wishing to exercise a right under the Act. It is published in each official language and is available from the Regulator:

3. Records available without a formal request

The following are already publicly available and may be obtained without a PAIA request:

Records are also kept in terms of, among others, the Companies Act 71 of 2008, the Income Tax Act 58 of 1962, the Value Added Tax Act 89 of 1991, the Basic Conditions of Employment Act 75 of 1997, the Labour Relations Act 66 of 1995, the Occupational Health and Safety Act 85 of 1993, and the Protection of Personal Information Act 4 of 2013.

6. How to request a record

  1. Complete the prescribed request form (Form 2, published by the Information Regulator at justice.gov.za/inforeg) and send it to the Information Officer at the address in section 1.
  2. Provide enough detail to identify the record and to identify yourself, and state the form of access required.
  3. State the right you are seeking to exercise or protect, and explain why the record is required for that purpose.
  4. If the request is made on behalf of another person, provide proof of your authority.
  5. Pay the prescribed request fee, where one applies.

We will respond within 30 days, which may be extended in the circumstances allowed by the Act. You will be notified of the decision and, where access is granted, of any access fee payable.

7. Fees

Fees are those prescribed in the regulations made under PAIA, as amended from time to time. They ordinarily comprise a request fee payable when the request is submitted and, where access is granted, an access fee covering reproduction, search and preparation time.

Because the prescribed amounts are set by regulation and change from time to time, we do not reproduce them here. The current schedule is published by the Information Regulator at inforegulator.org.za. We will confirm in writing what fees apply to your request, and what deposit (if any) is required, before any work is carried out.

8. Grounds for refusal

A request may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA, including the mandatory protection of the privacy of a third party who is a natural person, the commercial information of a third party, information supplied in confidence, and records privileged from production in legal proceedings.

9. If access is refused

If a request is refused, you may apply to a court for appropriate relief, or lodge a complaint with the Information Regulator, within the periods allowed by the Act.

This manual is available on this website, and on request at the hotel reception during office hours.
