Terms of use for this website and terms applying to bookings.

1. About this website

This website is operated by Atlantic Forest (Pty) Ltd t/a Atlantic Palms, registration number 2016/070535/07, of 17 Venus Circle, Sunset Beach, Cape Town, 7441, South Africa. By using this website you agree to the terms set out on this page.

2. Information required by the ECT Act

The following is published in terms of section 43(1) of the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

Complaints and disputes Please raise any complaint with the front desk first, at admin@atlanticpalms.co.za. Unresolved consumer complaints may be referred to the Consumer Goods and Services Ombud (cgso.org.za) or the National Consumer Commission.

2.1 Payment security

Payments made through our booking engine are processed by our booking and payment providers over an encrypted connection. We do not receive or store complete card numbers on our own systems.

2.2 Cooling-off and cancellation

The seven-day cooling-off right in section 44 of the ECT Act does not apply to accommodation, transport or catering booked for a specific date or period — this is the exception in section 42(2) of that Act. Your booking is therefore governed by the cancellation terms set out above and confirmed to you in writing.

Section 17 of the Consumer Protection Act 68 of 2008 separately allows you to cancel an advance reservation, subject to a reasonable cancellation charge. No cancellation charge applies where the booking could not be honoured because of the death or hospitalisation of the person for whom the booking was made.

3. Information on the site

We take care to keep descriptions, images and rates accurate and current. Even so, information on this site is provided for general guidance, may change without notice, and does not form an offer. Room images are representative; individual rooms vary in layout, outlook and finish. Rates, taxes, levies and availability are confirmed at the time your booking is confirmed.

4. What we offer

Atlantic Palms is a boutique beachfront hotel in Sunset Beach, Cape Town, offering accommodation, breakfast and dining and related guest services. This website exists to describe that offering to prospective guests and to let them enquire or book.

5. Bookings

5.1 Making a booking

A booking is only confirmed once we have issued a written confirmation and any required deposit has been received. The person making the booking must be at least 18 years old and warrants that they are authorised to accept these terms on behalf of everyone in the party.

5.2 Rates and payment

Rates are quoted in South African Rand and, unless stated otherwise, include VAT. Additional charges — such as tourism levies, meals not included in the rate and bar accounts — are payable on departure. A deposit of 50% of the booking total is required to confirm a reservation. The balance is payable on check-in. Where a rate or package states different payment terms, those terms apply.

5.3 Cancellation and no-show

Cancellation charges are calculated on how far before your arrival date we receive written notice of the cancellation:

A no-show, or departure before the booked departure date, is charged at the full value of the booking. Cancellations must be sent to reservations@atlanticpalms.co.za and are effective only once we have acknowledged them in writing.

These charges are the cancellation fee contemplated by section 17 of the Consumer Protection Act. No cancellation charge applies where the booking could not be honoured because of the death or hospitalisation of the person for whom the booking was made.

5.4 Bookings through third parties

Where you book through an online travel agent or other platform, that platform’s booking and cancellation terms apply in addition to these terms.

7. Payment

Payments may be made by the methods confirmed at the time of booking, which ordinarily include major credit and debit cards. Card details are captured and processed by our payment provider over a secure connection; we do not store full card numbers. We prefer payment by electronic funds transfer (EFT). We also accept the card types and payment methods supported by our payment gateway, which ordinarily include major credit and debit cards. Payment is in South African Rand.

8. Accessibility and special requirements

Some rooms are on upper floors reached by stairs, and others have level or wheelchair-friendly access. If you have mobility, accessibility or other special requirements, please speak to reservations before booking so we can place you in a suitable room.

9. Liability

Nothing in these terms excludes or limits liability where it may not lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or any liability under the Consumer Protection Act 68 of 2008 that cannot be excluded. Subject to that, we are not liable for indirect or consequential loss, and guests use the pool, parking and other facilities at their own risk. Valuables should be secured; please ask reception about safekeeping.

10. Not professional advice

Information, ideas and opinions published on this site are general in nature and are not professional advice, nor an official statement on any matter. Please consult an appropriate specialist where you need advice you intend to rely on.

11. Events beyond our control

We are not liable for a failure to meet our obligations where the cause is outside our reasonable control. That includes severe weather, fire, flood, natural disaster, epidemic, power or water interruption, industrial action, and acts of government or other authorities.

12. Intellectual property

The content of this website — including text, photography, the Atlantic Palms name and logo, and the design of the site — belongs to Atlantic Forest (Pty) Ltd t/a Atlantic Palms or its licensors. You may view and print pages for your own personal, non-commercial use. Any other reproduction or commercial use requires our written permission.

13. External links

This site links to third-party services such as booking platforms, review sites and social media. Those sites are not under our control and we are not responsible for their content, availability, or privacy practices.

14. Privacy

Personal information is handled in accordance with our Privacy Policy. Requests for access to records are dealt with under our PAIA Manual.

15. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.
